Private Commercial Litigation

The litigators in our Private department understand that it is not the size of the dispute that determines its importance in our clients' lives. Whatever the issue, we recognise that an individual may want to litigate in a different way and will have different concerns to a company making or defending the same claim.

Our heritage in private client work lies at the heart of the firm. We have a deep understanding of the needs of our private clients and the dynamics and politics of families, family businesses and personal relationships. Consequently, we are able to act as their trusted advisors, tailoring our advice to deliver results that fit each individual client and dispute.

Many of our clients own or run private businesses, facing many of the same issues as directors and shareholders of listed companies. Weak corporate governance, whatever the size of the entity, can lead to public, legal or regulatory challenges that inevitably damage reputation. In private businesses this can also be damaging personally. Directors carry potential personal liability, which brings with it the additional burden of protecting their individual position, including the risks to their - often significant - financial stake in the business. Meanwhile, if it is a family business, families, however well-intentioned, can fall out.

If a dispute, involving partnership, shareholders or members, has already arisen, or seems imminent, or where there is a clear external threat (such as regulatory or governmental action), we can help resolve these issues speedily, practically and with an eye to getting the business back on track as soon as possible.

Our team sits at the heart of our Private department, which means that we are also able to meet the needs of our clients in their wider personal and business lives, vis-à-vis reputation management, wealth planning and corporate and commercial advice.
