Has copyright protection fallen out of fashion? - design protection after Lambretta
Knowing whether your fashion designs will be protected by the courts in the UK or the rest of the EU has never been less certain. The fashion industry suffered a serious knock in July 2004 when the Court of Appeal rejected Lambretta's claims for protection of its colourway selection in the design of a tracktop. Joined by the QC who represented Lambretta, and with plenty of products on hand to aid our discussions, we will look at the implications of the decision and how the EU's unregistered design regime may be a source of hope for design led businesses.
